This website is operated by ROSÉ LASH. Throughout the site, the terms "we", "us" and "our" refer to ROSÉ LASH. ROSÉ LASH offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing products from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").
1. Formation of Contract
1.1 When you place an order, it constitutes an offer to purchase the selected products. Submitting an order creates an obligation for you to pay, but it does not create an obligation for us to provide those products. We will send you an order confirmation email, which acknowledges receipt of your order. This email does not constitute acceptance of your order.
1.2 A contract is formed only when we expressly accept your order in writing or dispatch the ordered products. Each contract pertains only to those products we have accepted. We are under no obligation to supply any products until acceptance.
2. Your Status
By placing an order, you warrant that you are legally capable of entering into binding contracts, and that doing so does not violate any law or third-party obligations. If you are an individual, you confirm that you are at least 18 years old and will use the products in strict accordance with all guidelines and requirements.
3. Our Status
We are a company registered in the Republic of Korea, with our principal office located in Hwaseong, Gyeonggi-do.
4. Product Descriptions and Pricing
4.1 We have taken reasonable care to describe all products as accurately as possible. However, slight variations may occur.
4.2 The prices of products are as quoted on our website, except in cases of obvious error. Shipping costs are not included in the prices displayed.
4.3 Prices are subject to change at any time, but such changes will not affect orders that have already been accepted.
4.4 Despite our best efforts, some products may be incorrectly priced. If the correct price is lower than the stated price, we will charge the lower amount when dispatching the product. If the correct price is higher, we will, at our discretion, contact you for instructions before dispatching the product or reject your order and notify you of the rejection.
5. Payment
All products must be paid for by credit card, debit card, PayPal, or any other payment methods specified on our website. We reserve the right to withhold delivery and/or cancel the contract if full payment is not received.
6. Product Availability and Delivery
6.1 Your order will be fulfilled without undue delay, and in any event within 14 days after acceptance, unless a different delivery date is specified.
6.2 If delivery is delayed, we will inform you, but we are not responsible for any losses or damages caused by reasonable or unavoidable delays.
6.3 Providing Accurate Delivery Information
Customers must provide accurate and complete delivery address and contact information. We are not responsible for delivery issues arising from incorrect information.
6.4 Customs Responsibilities
Customers are responsible for complying with their country’s customs procedures and regulations. Any costs incurred due to customs delays, rejections, or insufficient documentation (e.g., return shipping, storage fees, disposal costs) are the customer's responsibility.
6.5 Customs Delays and Product Disposal
If customs procedures are delayed or neglected by the customer, causing the products to be returned or disposed of, we reserve the right to charge the customer for any incurred costs. Additionally, the product cost will not be refunded.
6.6 Handling Returned Products
Products returned due to customs issues will not be re-shipped, and the customer will be responsible for return shipping and additional handling costs. If the customer desires re-shipment, they must cover the additional shipping costs.
6.7 Customs Procedure Guidance
We may provide guidance on customs procedures as needed, but we are not obligated to do so. The final responsibility for import customs, taxes, certifications, and regulations lies with the customer.
7. Adhesive Products – For Professionals Only
7.1 Adhesive products intended for professional use carry the risk of personal injury if not used properly. Therefore, we supply these products only to professionals who hold certification in individual eyelash extension application and are fully insured.
7.2 We may require proof of qualifications from those ordering professional adhesive products and reserve the right to cancel orders if qualifications are deemed insufficient.
8. Consumer Rights
8.1 If you are contracting as a consumer, each contract is subject to your right of cancellation as set out in this clause.
8.2 If you wish to cancel your order and receive a refund:
a) Contact us as soon as possible and return the products within 7 days of receipt. The products must be unused and in their original packaging.
b) The cancellation period expires 7 days after you (or someone nominated by you) receive the products.
c) If the order has already been dispatched, we must receive the products back before proceeding with the refund.
d) Some banks charge fees for international transactions. We can only refund the amount we received, excluding any bank charges.
8.3 To exercise the right to cancel, you must inform us in writing (e.g., by post, fax, or email). Our contact details are: email info@jstkor.com.
9. Risk and Ownership
The products will be at your risk from the time you receive them. Ownership of the products will pass to you only when we receive full payment.
10. Returns and Refunds
10.1 If you act as a consumer and exercise your right of cancellation under the regulations and have received the products:
a) You must return the products within 7 days of receipt.
b) You will bear the cost of returning the products.
c) You must take reasonable care of the products while they are in your possession and are liable for any diminution in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the products.
10.2 If you cancel the contract under your right of cancellation, we will refund all payments received from you, including the costs of delivery.
10.3 If the products are defective, we will examine the returned products and notify you of your refund via email within a reasonable period. We will usually process the refund due to you as soon as possible, and in any case within 30 days of confirming that you are entitled to a refund.
11. Limitation of Liability
11.1 We are under a legal duty to supply products that conform to the contract.
11.2 Except as expressly provided in this contract, we are not responsible for indirect or consequential losses.
12. Data Protection and Security Checks
12.1 The collection, processing, storage, and protection of any personal data you provide is of key importance to us and will be treated securely.
12.2 To ensure your credit, debit, or charge cards are not being used without your consent, we validate your name, address, and other personal data against appropriate third-party databases.
13. Notices
All notices you provide to us must be sent to ROSÉ LASH’s registered address or via email to info@jstkor.com.
14. Force Majeure
We will not be liable or responsible for any failure to perform or delay in performance of any of our obligations under a contract that is caused by events outside our reasonable control.
15. Waiver
If we fail to insist upon strict performance of any of your obligations under the contract or these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies.
16. Severability
If any part of these terms and conditions is found to be invalid, unlawful, or unenforceable by any court or other competent authority, that part will be severed from the remaining terms and conditions, which will continue to be valid to the fullest extent permitted by law.
17. Entire Agreement
These terms and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding, or arrangement between us, whether oral or in writing.
18. Changes to Terms and Conditions
We reserve the right to revise and amend these terms from time to time to reflect changes in market conditions, technology, payment methods, relevant laws and regulatory requirements, and our system's capabilities.
19. Governing Law and Jurisdiction
These terms of use and any contracts for the purchase of products through our website will be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from or related to such contracts shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.
